Liability Waiver

We want every visit to Traverse City Whiskey Co. to be safe, enjoyable, and memorable. Because our tours, classes, tastings, and events may take place in active production and hospitality environments, all participants must review and accept the following waiver. Please read carefully. By accepting this agreement, you are giving up certain legal rights.

Participation

I voluntarily choose to participate in a Traverse City Whiskey Co. tour, tasting, cocktail class, private event, facility rental, barrel experience, or other activity associated with my reservation or visit. I understand that Traverse City Whiskey Co. locations may include working production areas, industrial equipment, barrels, stairs, loading areas, wet or uneven surfaces, glassware, hot liquids, tools, machinery, noise, and other conditions normally associated with a distillery, tasting room, or event venue.

Assumption of Risk

I understand that participation may involve risks, including slips, trips, falls, cuts, burns, allergic reactions, exposure to production equipment, actions of other guests, alcohol-related impairment, and other foreseeable or unforeseeable injuries. I knowingly and voluntarily accept these risks and assume full responsibility for any injury, illness, death, property damage, or other loss arising from my participation, except where liability cannot legally be waived.

Alcohol and Personal Responsibility

If I consume alcohol, I confirm that I am at least 21 years old. I understand that alcohol consumption is voluntary and may impair judgment, coordination, and reaction time. I agree to drink responsibly, follow all staff instructions, remain within designated guest areas, and avoid operating a vehicle or equipment while impaired. Traverse City Whiskey Co. may refuse or discontinue alcohol service or participation whenever it determines that doing so is appropriate for safety or legal compliance.

I am responsible for informing staff of any relevant allergies, dietary restrictions, medical conditions, or physical limitations before participating. I will not consume any product if I am uncertain about its ingredients or suitability for me.

Release of Liability

To the fullest extent permitted by Michigan law, I release and discharge TCWC, LLC, doing business as Traverse City Whiskey Co., together with its affiliated entities, locations, property owners, members, managers, officers, employees, agents, contractors, event partners, and insurers from claims arising from my participation or presence on the premises, including claims involving personal injury, illness, death, or property damage. This release includes claims resulting from the ordinary negligence of a released party. It does not apply to gross negligence, willful misconduct, or any liability that cannot legally be waived.

Responsibility for My Conduct

I accept responsibility for my actions and agree to reimburse the released parties for claims, damages, or expenses caused by my intentional misconduct, violation of staff instructions, or unsafe behavior. If emergency assistance is reasonably considered necessary, I authorize Traverse City Whiskey Co. to contact emergency services. I understand that I remain responsible for any medical or transportation expenses incurred on my behalf.

Agreement

By checking the acknowledgment box when I complete my reservation, I confirm that:

• I have read and understand this agreement.
• I have had the opportunity to ask questions before accepting it.
• I am accepting this agreement knowingly, freely, and voluntarily.
• I am legally competent to enter into this agreement.
• I am accepting this agreement for myself and for every adult participant included in my reservation.
• My electronic acceptance has the same legal effect as a handwritten signature.

Governing Law

This agreement is governed by Michigan law. If any portion is found unenforceable, the remaining provisions will continue in effect.
